 IPG RENTAL TERMS AND CONDITIONS

IPG agrees to lease equipment and related accessories (herein collectively referred to as Equipment) to Customer subject to the following terms and conditions.

Payment

  • All rentals are to be paid via credit card PRIOR to equipment leaving IPG.

  • Rentals that are cancelled with less than 24-hour notice will be charged for a full day rental. IPG will charge the full rental order amount for orders that are no-shows.

  • Customer authorizes IPG to charge customer credit card for late return fees, repair fees for damaged equipment, and/or replacement fees for missing items.

  • Customers without a billable account may be required to have a credit hold for the order replacement value placed on your credit card.

  • All rentals are subject to local sales tax based on the location equipment is released to customer. Federal or Colorado State Tax Exempt Certificates, or Colorado State Resale License must be presented and approved in advance of rental to be exempt from sales tax.

  • Customer will reimburse IPG for all costs and expenses of collection of any amounts owed to IPG under this or any other agreement including, but not limited to, reasonable attorney fees.

Terms

  • Valid Photo ID is required at the time equipment is picked up.

  • IPG reserves the right to deny renting of Equipment to anyone it feels is unqualified to use or transport the equipment appropriately.

  • Customer agrees to fully inspect Equipment and confirm all items are accounted for and are in good working condition prior to receiving. Customer agrees that any person receiving equipment on their behalf will do the same.

  • Failure of Equipment to perform due to adverse conditions, improper set-up, improper usage, or operator error does not release the Customer from rental charges.

  • Customer agrees to defend, indemnify, and hold IPG, its parent, subsidiary and affiliated companies and their owners, officers, and employees (hereinafter designated as “IPG” or “Us” or “We” or “Our”) harmless from and against any and all claims, actions, causes of action, demands, rights, damages of any kind, costs, loss of profit, expenses and compensation whatsoever including court costs and reasonable attorney fees (“Claims”), in any way arising from, or in connection with, the Equipment rented/leased (“Equipment”), including, without limitation, as a result of its use (regardless if the Equipment is installed or set up by Us), maintenance, or possession, irrespective of the cause of the Claim, except as the result of Our sole negligence or willful misconduct, from the time You take care, custody or control of the Equipment, until the Equipment is returned to IPG care, custody and control.

  • Customer is responsible for loss, damage or destruction of the Equipment, including, but not limited to losses while in transit, while loading and unloading, while at any location (regardless if the Equipment is installed or set up by IPG), while in storage, and while being used in any manner whatsoever. Customer shall be responsible for any loss of use and shall fully compensate IPG for the loss of use of the Equipment during the time it is being repaired or replaced, as applicable.

Insurance

  • Customer is required to provide adequate proof of insurance equal to or greater than the total replacement value of all equipment being rented. Customer must provide IPG with a Certificate of Insurance (COI) naming IPG as Loss Payee prior to rental. Customers unable to provide proof of insurance must complete and submit a credit card authorization form approving charges in the event of loss or damage. Uninsured renters may be disqualified from renting certain types of equipment or from renting equipment above a replacement value of $2,000.00.

Delivery/ Pickup & Shipping

  • IPG reserves the right to not allow equipment to be shipped via inappropriate or unsafe means. Please show up with a vehicle appropriate for what you are renting.

  • Please inform IPG if anyone other than the person who placed an order (the "Renter") will be picking up the order. IPG will not send out equipment with anyone that cannot be verified as the renter or approved by the renter. Customer agrees to all terms and conditions regardless of who receives equipment on their behalf.

  • Renter is liable for the equipment from the time it leaves IPG until its return to IPG. Any loss, damage, or late returns are solely the responsibility of the renter, regardless of who returns and assumes all risk of transportation and shipping of Equipment, including but not limited to loss, damage, or delays.

  • All transportation costs are to be the sole responsibility of and paid by Customer. Return shipments to IPG must be prepaid. Delivery charges will apply for deliveries to airports, shipping carriers, or other common carriers.

  • Delivery & Pickup is defined as door-to-door service. This does not include load-in, set-up, strike or load-out of equipment. Customer alone is responsible for a crew to load/unload equipment from the vehicle and drayage between the dock area and venue.

Missing, Damaged, & Dirty Equipment

  • Equipment must be returned in the same condition as when released from IPG.

  • Missing Equipment will continue to be charged at daily rates until the Equipment is returned, or until a replacement invoice is issued AND PAID. Rental charges will not be deducted from the replacement costs.

  • Damage to Equipment includes anything determined by IPG to be above and beyond normal wear and tear. Items returned scratched, dented, or cosmetically damaged are subject to a repair or replacement charges, regardless of working condition.

  • IPG will charge a handling fee for equipment returned in dirty or messy condition. This fee shall be $95.00 per man-hour (1-Hour Minimum) and will be charged for any time spent on items such as cleaning dirty equipment, rewrapping/untangling cables, refolding of drape, soft goods, and screen surfaces, and reorganizing equipment in cases. Handling fees will be billed separately or may be deducted from any received deposits.

  • Customer shall not make any alterations, additions, or improvements to the Equipment. IPG property labels and/or bar codes shall not be removed or altered from any piece of Equipment.

Tech Support

  • Customer must notify IPG of any equipment failure IMMEDIATELY, including after hours, in order to be considered for adjustment of rental charges. AFTER-HOURS TECH SUPPORT can be reached at 720-510-3709.

  • IPG will make every effort to fix or replace any rental equipment that has a failure as quickly as possible. Adjustments to rental charges will not be made if equipment is fixed or replaced in a reasonable amount of time.

  • Tech-Support charges may be incurred by Customer for service calls responding to failure of equipment due to adverse conditions, improper set-up, improper usage, or operator error.

  • IPG makes no warranty, express or implied, regarding Equipment, including without limitation, any warranty of merchantability or fitness for any purpose. IPG’s obligation to Customer shall be limited to the repair or replacement or faulty equipment, or refund of IPG rental fees of Equipment which is defective, and Customer agrees that this shall be its sole and exclusive remedy. Equipment is available for inspection and testing at our location prior to rental.

Agreement

This agreement shall be governed by the internal laws of the State of Colorado, and the rights and obligations of the parties hereunder shall be determined according to such laws. Customer submits to venue and jurisdiction over any dispute related to this agreement in the Superior Court of Jefferson County, Colorado. This agreement shall constitute the entire agreement between IPG and the Customer with respect to the rental of Equipment and may not be modified without an authorized representative of IPG.
